10. Invalidity
If any part of the Terms of Use is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Use will not be affected and all other clauses remain in full force and effect. So far as possible where any clause/subclause or part of a clause/subclause can be severed to render the remaining part valid, the clause must be interpreted accordingly. 12. Device Lock and Factory Reset (Frum Phone App)
12.1 ShomerDNS's Frum Phone application (the App) functions as a Device Owner application under Android's enterprise management framework. As a core part of its content-filtering purpose, the App is capable of restricting or fully disabling the device's ability to perform a factory reset and other device administration functions, so that the restrictions it applies cannot be bypassed by the device's primary user (e.g., a minor).
12.2 By provisioning a device with the App, you acknowledge and agree that:
12.2.i This is intentional, not a bug. The App is designed to make factory reset and other bypass methods unavailable while its restrictions are active. This is a core security feature, not a defect.
12.2.ii The unlock path lives inside the App. Restrictions applied by the App, including the factory-reset block, are intended to be removed only from within the App itself (via administrator PIN and the appropriate unlock controls) before a factory reset or other administrative action becomes possible. If the App crashes, is corrupted, is uninstalled or interrupted mid-setup, or otherwise becomes non-functional while these restrictions are active, the device may become permanently unable to be factory reset, reconfigured, resold, or serviced by any means other than manufacturer-level intervention (if one exists at all).
12.2.iii No guaranteed recovery. You acknowledge that loss of the administrator PIN, an interrupted or duplicated provisioning attempt, an app malfunction, or an incompatible OS update occurring while device restrictions are active may leave the device in a state that cannot be recovered by the developer, by you, or in some cases by the device manufacturer. The App's developer does not guarantee that any such device can be restored to a usable or resettable state.
12.2.iv Assumption of risk. You assume full responsibility for maintaining access to the App's administrator PIN and for following setup and unlock instructions exactly as provided. You provision a device with the App at your own risk.
12.2.v No warranty; limitation of liability. To the fullest extent permitted by law, the Website Owner shall not be liable for any loss of use, loss of data, loss of access to a device, cost of device replacement or repair, or any direct, indirect, incidental, or consequential damages arising from a device becoming locked, unresettable, or otherwise unusable as a result of using the App.
12.2.vi Recommended safeguards. You are strongly advised to record the administrator PIN in a safe, retrievable location separate from the managed device, to avoid interrupting the provisioning process once started, and to unlock restrictions through the App before attempting any factory reset, OS update, or device transfer.
